Shriver Center Presented with “Cy Pres” Award Resulting from Landlord-Tenant Litigation

Donation from Berton N. Ring, P.C., will benefit anti-poverty work

Chicago, IL – (March 25, 2015) – Attorneys from Berton N. Ring, P.C., a boutique consumer and commercial litigation firm, gathered on Thursday, March 12 to present a $19,000 cy pres award to the Sargent Shriver National Center on Poverty Law. Cy pres awards are residual funds in class action cases that are unclaimed or cannot be distributed to the class members. Under the cy pres doctrine, courts can distribute these residual funds to appropriate charitable causes.

The award arose out of a class action lawsuit, Riley v. Dixie Garden Homes, Inc., originally filed in 2011 by Berton N. Ring, P.C. The case alleged multiple violations of the Illinois Mobile Home Landlord and Tenant Rights Act including failure to pay interest on a security deposit, attempt to enforce illegal lease provisions, wrongful eviction, both statutory and common law fraud, and more. Following settlement and payout to the class, the remaining settlement funds were presented to the Shriver Center.
